amazon is facing a class-action lawsuit accusing the company of deceptive pricing practices. The suit alleges that amazon misled buyers by displaying inflated prices for Fire TVs, making discounts appear larger than they actually were.
The lawsuit was filed in the U.S. District Court for the Western District of Washington and claims the company regularly engaged in this practice, calling it a “persistent and uniform scheme.” The suit alleges amazon created “false price listings” for its own Fire TVs, making the apparent “discounts” misleading.
The lawsuit goes on to accuse the company of misleading its customers into purchasing Fire TVs by omitting “critical information” about the duration of the offer and when the list price was actually used. This allegedly led amazon customers to spend “more money than they would have spent but for the purported limited-time offers.” The lawsuit claims that “many of the Fire TVs have not been anywhere near their advertised list prices for a year or more.”
The lawsuit alleges violations of Washington Consumer Protection Actwhich prohibits “unfair methods of competition and unfair or deceptive acts or practices in the conduct of any trade or business.” Plaintiff David Ramirez is seeking compensatory and punitive damages, as well as an injunction to stop amazon from continuing the alleged practices. The suit seeks compensatory damages “in amounts to be determined by the court and/or jury” and prejudgment interest on all awards.
The claim refers to a Similar case in California Starting in 2021, amazon will no longer be able to use false or misleading list prices in its advertising.
