Court decree stops the exhibition of NFTs
The saga took a new turn when Judge Jed S. Rakoff of the United States District Court issued a final ruling with a permanent injunction, effectively stopping Rothschild's alleged trademark violations with respect to Hermès.
More recently, Rakoff has expanded this ban by preventing MetaBirkins assets from being displayed at Stockholm's Spirit Museum. This decision followed Rothschild's request for legal clarification on the exhibition, despite the previous court verdict.
In his latest comments, Rakoff openly called Rothschild a “straight-up scammer,” and the nft creator disputed this accusation.
Looking ahead, Rothschild continues to challenge the court ruling from the previous year and there is still an ongoing appeal in New York's Second Circuit Court.
Rhett Millsaps, Rothschild's lawyer, will file a motion for reconsideration, marking the next chapter in a legal saga that questions the limits of artistic NFTs and corporate trademarks.
