…the Court issued a preliminary order against Defendant Shkreli: (1) enjoining him from possessing, using, disseminating, or selling any interest in the Album, including its data and files, or from in any way causing further harm to Plaintiff with respect to the Album through this conduct; (2) ordering him to provide an inventory and accounting of the copies of the Album he has retained and the persons to whom he has distributed the data and files, and any associated proceeds; and (3) ordering him to deliver to his attorney all recordings of the contents of the Album that Defendant owns or controls. A written order will be issued hereunder. In addition, the following deadlines were established: (1) by August 30, 2024, Defendant must file (A) a sworn declaration by Defendant, under penalty of perjury, that he has delivered all of his copies, in any form, of the Album or its contents to his defense counsel, and that he no longer possesses any copies, in any form, of the Album or its contents, and (B) a letter confirming that defense counsel has possession of such copies and contents; and (2) by September 30, 2024, Defendant must file an accounting, in the form of an affidavit by Defendant, under penalty of perjury, identifying (A) all known copies, in whatever form, of the Album or its contents, (B) whether such copies were distributed and, if so, when, to whom, and how, and (C) the amounts, source, timing, and nature of any income, profits, or other financial benefits derived by Defendant from its distribution or reproduction of the Album or its contents.
